1. Who we are
charlotte-sydney.com is operated by DONT SLEEP LLC, a limited liability company registered in Wyoming, United States, trading as Charlotte Sydney. Browsing the site or placing an order means you accept these terms. Nothing in them excludes, restricts or modifies the guarantees you hold under the Australian Consumer Law or your rights under the Australian Consumer Law, which apply to consumer purchases regardless of anything written here.
2. Age and accounts
You need to have reached the age of majority where you live in order to buy from us. Where you hold an account, its credentials are yours to keep safe and its activity is yours to answer for. Contact us if you think it has been misused.
3. Our products
We describe measurements, materials and fit as accurately as we can. Colour still renders differently from screen to screen, and studio lighting still flatters a fabric. That variation comes with buying online and is not a defect. Where goods genuinely fail to match the description we gave, the Returns & Refund Policy and the Australian Consumer Law take over.
4. Orders
An order is an offer to buy. We may decline or limit one where stock has gone, payment cannot be authorised, a price is obviously wrong, fraud is suspected, or supply would be unlawful. Where we cancel an order you have already paid for, you are refunded in full without delay. Goods are sold for personal or household use, not commercial resale or export.
5. Prices, currency and billing
All prices are shown and charged in US dollars (USD). Where your card or account is held in another currency, your bank converts at its own rate and may apply a foreign transaction fee; those charges are set by your bank and are not received by us. Prices may change, but the binding price is the one displayed when you ordered and repeated in your confirmation. Delivery and any other costs appear before payment. 6. Delivery and risk
Delivery has occurred once you, or a third party you nominated who is not the carrier, physically holds the goods. Until then the risk is ours. Delivery times are estimates given in good faith; goods must be delivered within a reasonable time, as the Australian Consumer Law requires. Detail is in the Shipping Policy.
7. Returns
We offer a voluntary 30-day window for change-of-mind returns, and orders can be cancelled free of charge within 24 hours if they have not been dispatched. Conditions, costs and refund timings are set out in the Returns & Refund Policy. This window is additional to your consumer guarantees and does not replace them.
8. Consumer guarantees and faulty goods
Goods supplied to a consumer must be of acceptable quality, match their description and any sample shown, and be reasonably fit for any purpose you made known to us before buying.
Where a guarantee is not met and the failure can be remedied, you may require us to remedy it within a reasonable time; if we fail or refuse, you may have it remedied elsewhere and recover the reasonable cost, or reject the goods. Where the failure is of a substantial character or cannot be remedied, you may reject the goods and choose a refund or a replacement of the same type and similar value, or keep them and claim compensation for the reduction in value. You may also claim for other reasonably foreseeable loss caused by the failure.
9. Intellectual property
Text, photography, graphics, logos and layout are ours or licensed to us. Personal, non-commercial use is fine; copying, redistributing or exploiting them commercially without written permission is not, except where the law allows.
10. Third-party tools and links
Some features come from third parties, outside our control, supplied as they are and without warranty; their own terms apply. We take no responsibility for the content of sites we do not operate, nor for purchases made on them.
11. Reviews and submissions
Send us a review or photograph and you keep ownership while granting us a non-exclusive right to display and use it for the store and its marketing. You confirm that publishing it infringes nobody's rights. Unlawful or offensive material may be removed. We never edit a review into something that misrepresents an opinion, and any review obtained through an incentive is disclosed as such, as the Australian Consumer Law requires.
12. Personal information
Handled as described in our Privacy Policy. Accepting these terms is not, by itself, consent to optional cookies, personalised advertising or marketing email.
13. Errors and corrections
Where a price, description or availability figure is wrong, we may correct it and cancel affected orders even after submission, refunding in full.
14. Prohibited uses
No unlawful purposes, no infringing anyone's rights, no harassment, no spam, no impersonation, no malicious code, no scraping or harvesting, no interfering with the security of the site. Breach may cost you access.
15. Warranties and liability
Beyond what we state expressly and what the law confers and forbids us to exclude, the site and its content are provided as they are. Nothing here limits our liability further than the law permits — in particular, nothing excludes the Australian Consumer Law in respect of consumer purchases. We are not liable for indirect losses that could not reasonably have been foreseen.
16. Indemnity
You will hold us harmless against third-party claims, including reasonable legal costs, arising from your breach of these terms or of the law, or from your use of the site.
17. Severability, termination and entire agreement
An unenforceable clause is applied as far as the law permits and severed for the rest, which stands. Either party may end the arrangement, with clauses that ought to survive surviving. These terms and the policies linked from them are the whole agreement. Not enforcing a right once waives nothing.
18. Events outside our control
Extraordinary events beyond our reasonable control may delay performance. We tell you and work to limit the effect. This does not limit your consumer guarantees in the event of delay, faulty goods or non-delivery.
19. Governing law and disputes
These Terms of Service and any separate agreements whereby we provide you shall be governed by and construed in accordance with the laws of Wyoming, United States

Come to us first. Beyond that, free guidance is available from the ACCC at accc.gov.au, complaints about misleading or deceptive conduct go to the ACCC or to your state or territory fair trading office, and the relevant civil and administrative tribunal (for example NCAT in New South Wales or VCAT in Victoria) remains open to you.
20. Changes to these terms
We revise this page as the business and the rules change. The version in force when you ordered governs that order; later changes are not retroactive. The date at the top shows the current text.
